Are you a deployer of AI Systems?

• Obtaining all the mandatory instructions and technical documentation from the provider of high-risk AI Systems concerning the functioning of the high-risk AI System.
• Carrying out a Fundamental Rights Impact Assessment (“FRIA”) when deploying high-risk AI Systems and, where the AI System also processes personal data, coordinating the FRIA with the relevant Data Protection Impact Assessment (“DPIA”) to ensure consistency.
• Fulfilling the user-facing transparency requirements for limited-risk AI Systems (such as chatbots and deepfakes), where appropriate, in coordination with the existing transparency measures stemming from other legislative requirements (e.g., GDPR, Consumer Law, DSA, P2B Regulation).

Are you a provider of AI Systems?

We can support you in:

• Fulfilling the applicable data governance and data quality requirements for the data sets used to train high-risk AI Systems.
• Drafting the mandatory instructions and technical documentation concerning the functioning of high-risk AI Systems.
• Ensuring that the high-risk AI System is designed and developed in such a way, including with appropriate human-machine interface tools, that it can be effectively overseen by natural persons.
• Adhering to the mandatory cybersecurity requirements for high-risk AI Systems and ensuring that the AI System follows the principle of security by design and by default.
• Support in carrying out the conformity assessment procedure for high-risk AI Systems with a view of obtaining the “CE” marking.
• Liaising with the competent supervisory authority in order to participate in a regulatory sandbox for the development, testing and validation of innovative AI systems for a limited time before their placement on the market or putting into service of said system.

Are you an importer of AI Systems?

We can support you in:

• Assessing whether the provider of the high-risk AI System to be imported has undertaken the relevant conformity assessment procedure, has drawn up the technical documentation in accordance with Annex IV, whether the system bears the required CE conformity marking and is accompanied by the EU declaration of conformity and instructions of use, and whether the authorised representative in the EU been established by the provider.
• Liaising with the competent supervisory authority as necessary, in case whether the documentation sent by the provider is lacking or false.

Are you a distributor of AI Systems?

We can support you in:

• Assessing whether the high-risk AI System to be distributed bears the required CE conformity marking, whether it is accompanied by a copy of EU declaration of conformity and instruction of use, and whether the provider and the importer of the system, as applicable, have complied with their obligations.
• Evaluating and putting in place the corrective actions necessary to bring the high-risk AI system into conformity with the relevant requirements, evaluating whether it is necessary to withdraw it, recall it, notify the non-conformities with the supervisory authority, or to ensure that the provider, the importer or any relevant operator, as appropriate, takes the relevant corrective actions.
